Terms of Service

Terms and conditions of use for our services.

Introduction

These Terms of Service ("TOS") govern the relationship between Packet25 ("we", "us", "our") and you, including your heirs, assigns, agents, and contractors (collectively, the "Customer"). These Terms become effective upon electronic, verbal, or written acceptance, or upon first use of the Services - whichever occurs first. By subscribing to any of our services ("Services"), the Customer agrees to be bound by these Terms and Conditions.

Term of Contract

Unless otherwise specified, the contract is established for a minimum term of one month. If no termination notice is submitted before the end of the initial term, the contract will automatically renew for an additional minimum term.

The contract becomes effective on the agreed activation date or on the date the Customer begins using the Services — whichever occurs first.

Fixed-term contracts automatically end at the expiration date stated in the contract. A fixed-term contract may be renewed by extending its duration.

Customer Responsibilities

The Customer must not engage in any activity that is illegal under local, national, or international law while using the Services provided by Packet25.

The following types of content and activities are strictly prohibited, including but not limited to:

  • Copyright-infringing content such as videos, audio, text, software, or any other material distributed without the explicit permission of the copyright holder.
  • IRC-related software, including IRC clients, servers, bots, and web-based IRC applications.
  • Proxy or VPN services, including any proxy/VPN setup, operation, or traffic routing through remote proxy connections.
  • HYIP (High Yield Investment Programs) or any website that promotes, advertises, or supports such schemes.
  • Warez, pirated or cracked software, hacking tools, emulators, or instructions facilitating illegal activities.
  • Spyware, malware, scareware, or the distribution of viruses or malicious software. Any activity that may compromise the security of others will result in immediate termination of the account.

The Customer agrees to keep all login credentials and access information to their server strictly confidential. Sharing access with unauthorized third parties is prohibited. The Customer is solely responsible for preventing unauthorized access to their systems.

The Customer must notify Packet25 immediately of any service disruptions, hardware or software malfunctions, or any illegal or potentially illegal activities detected on their services, including those carried out by unauthorized parties.

The Customer is responsible for using the leased infrastructure with due care. Intentional misuse, abuse, or damage may result in financial liability.

The Customer is solely responsible for maintaining regular backups of all data and files associated with their Services. While Packet25 may perform internal backups for maintenance or operational needs, we are not responsible for any data loss or data corruption under any circumstances.

Billing

Prices are displayed in EUR and CHF for convenience. Payment can be made using any method offered on our payment page.

Services are billed on a monthly basis unless otherwise agreed. The first invoice will include all initial charges, including any setup or installation fees when applicable.

Invoices are issued 14 (fourteen) days before the due date. Payment must be received on or before the due date to avoid service interruption. If payment is not received, the Service will be suspended 7 (seven) days after the due date. If the outstanding balance remains unpaid, the Service will be permanently terminated 14 (fourteen) days after suspension.

Liability

Packet25 is not liable for any failure or delay in the performance of its Services when such failure or delay results from circumstances beyond its reasonable control. These circumstances include, but are not limited to:

  • Actions of governmental authorities
  • War, insurrection, or sabotage
  • Embargoes
  • Fires or floods
  • Strikes or other labor disputes
  • Transportation delays
  • Equipment failures
  • Interruptions or delays in telecommunications or third-party services (including DNS propagation)
  • Failures of third-party software or hardware
  • Inability to obtain necessary materials, supplies, or power required to provide the Services

Packet25 is not responsible for any damage, downtime, or service interruption caused by third-party actions such as DDoS attacks, hacking attempts, malware, or other forms of hostile activity.

The Customer may be held financially liable for any damages caused to Packet25 or to third parties as a result of the Customer's use or misuse of the Services.

Termination

Packet25 reserves the right to refuse, suspend, or terminate the Services at its sole discretion and without prior notice if the Customer is reasonably deemed to pose a risk to the integrity or security of our network, if the Customer violates these Terms or the Acceptable Use Policy (AUP), if complaints are received regarding the Customer's activities, or in cases of non-payment of outstanding invoices.

The Customer may terminate the contract at any time before the automatic renewal date. When a valid termination notice is submitted, the contract will expire at the end of the current minimum term and will not renew. Fixed-term contracts automatically expire at the final date specified and cannot be terminated prior to that date unless expressly allowed.

The Customer is responsible for ensuring that payments are made correctly. In cases of early cancellation or overpayment, no refunds will be issued.

Governing Law

This Agreement is governed by, and shall be interpreted in accordance with, the laws of Switzerland. Both parties agree to submit to the exclusive jurisdiction of the Swiss courts for any dispute arising out of or relating to these Terms or the Services.

Amendments

Packet25 reserves the right to modify or update these Terms of Service at any time and without prior notice. We will make reasonable efforts to inform the Customer of significant changes. Continued use of the Services after such changes constitutes acceptance of the updated Terms.
