DSA & DMCA Policy

Digital Services Act & Copyright Compliance

This page outlines the procedures followed by Packet25 ("we", "us", "our") in compliance with the EU Digital Services Act (DSA) and the U.S. Digital Millennium Copyright Act (DMCA).

It explains how individuals or organizations ("Complainants") may submit notices regarding:

  • allegedly illegal content under the DSA
  • alleged copyright infringement under the DMCA

This policy applies to all users of Packet25 servers, infrastructure, websites, and related services.

Unless otherwise indicated, terms used here have the meaning set out in our Terms of Service.

Important Disclaimer – Please Read Before Sending Any Abuse Report

Packet25 provides dedicated servers, VPS, and infrastructure services, giving customers full administrative access and control over the hosted content.

We generally do not monitor, control, or access customer-hosted data.

Therefore:

Under both the DSA and the DMCA, Packet25 can only remove or disable access to content if:

  • We obtain actual knowledge of illegal content or clear infringement, or
  • We receive a valid order from a competent judicial or administrative authority.

If you cannot provide the required legal basis (see the forms below), you should contact the administrator of the original hosting source, as Packet25 cannot remove or alter content it does not control.

When Packet25 operates strictly as a hosting provider, we act expeditiously to remove or disable access to illegal content upon receiving proper notice or awareness, as required by law.

1. Digital Services Act (DSA) – Notice of Illegal Content

If you believe content hosted by Packet25 violates EU law, you may submit a DSA Notice. Your notice must include:

  • A detailed explanation of why the content is illegal.
  • Exact location of the content (URL(s), paths, or identifiers).
  • Your name and email address, unless reporting an offense listed under Articles 3–7 of EU Directive 2011/93/EU.
  • A good-faith statement confirming the accuracy of the notice.

Notices must be in English.

Upon receiving a valid notice, Packet25 will act according to the DSA, which may include removing or disabling access to the content.

Misrepresentations (DSA)

Under Article 20(2) DSA, knowingly submitting misleading information may result in liability for damages.

2. DMCA Policy – Notice of Claimed Copyright Infringement

If you believe your copyrighted material is being infringed by content hosted on Packet25 servers, you may file a DMCA Notice.

Your DMCA Notice must include:

  • Your physical or electronic signature.
  • Identification of the copyrighted work.
  • Identification of the allegedly infringing material + exact location.
  • Contact information: name, address, phone, and email.
  • A good-faith statement that the use is not authorized.
  • A statement under penalty of perjury that the notice is accurate and you are authorized to act.

Packet25 will take action required under the DMCA upon receipt of a valid notice.

3. DMCA Counter-Notification

If you believe content was removed or disabled in error, you may file a Counter-Notice including:

  • Your physical or electronic signature.
  • Identification of the removed material + previous location.
  • A statement under penalty of perjury that the removal resulted from mistake or misidentification.
  • Your name, address, phone number.
  • A statement that you consent to the jurisdiction of the relevant U.S. Federal Court (if outside the U.S., the jurisdiction of Washington, D.C.)
  • Agreement to accept service of process from the original complainant.

If the complainant does not file a court action within 10 business days, Packet25 may restore the content.

4. Repeat Infringer Policy

Packet25 may terminate services for customers who are determined to be repeat infringers, according to applicable law and at Packet25's sole discretion.

5. No General Monitoring

Packet25 is not obligated to monitor content transmitted or stored through our infrastructure, nor to proactively search for illegal activity.

However, Packet25 may take limited proactive measures when legally permitted, such as:

  • detection of known child abuse material
  • compliance with legal orders
  • system-level anomaly detection related to security incidents

6. Safe Harbor Protections

As a hosting and intermediary service provider, Packet25 is not liable for user-stored content provided that we act expeditiously after obtaining knowledge of unlawful content or valid orders.

This safe harbor is recognized under:

  • Article 6 DSA
  • 17 U.S.C. § 512(c) DMCA

7. Compliance With Legal Orders

Packet25 will comply with valid judicial or administrative orders from competent authorities within the EU, U.S., or other jurisdictions where applicable.

All such orders are verified for authenticity and validity before any action is taken.

8. Modifications to This Policy

Packet25 may modify this combined DSA/DMCA Policy at any time. Changes take effect upon publication on our website.
